Terms of Service

1. Acceptance of Terms

By accessing and using Marblism, Inc ("Company", "we", "our", "us") AI Agent Platform, you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our platform.

2. Description of Services

We provide an AI-driven platform that automates business processes through AI agents. Our services may include software, APIs, and integrations with third-party platforms. We may modify, add, or discontinue individual features, AI agents, models, or integrations from time to time, provided we maintain the core functionality of your subscription.

3. User Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account.
  • You agree not to share your login credentials or allow others to access your account.

4. Acceptable Use

By using our platform, you agree to:

  • Use the services only for lawful purposes.
  • Not engage in any activity that may harm, disrupt, or overburden our platform.
  • Not attempt to gain unauthorized access to any part of our system.

5. AI Agent Interactions

  • Our AI agents generate responses based on input data and probabilistic models. AI technology is inherently imperfect and can make mistakes.
  • We do not guarantee the accuracy, completeness, reliability, or timeliness of any AI-generated output. AI agents may produce incorrect, incomplete, outdated, biased, or fabricated information (sometimes called "hallucinations").
  • AI-generated content may not reflect current facts, laws, or your specific circumstances, and may misinterpret instructions or context.
  • You acknowledge that AI-generated content should not be relied upon as the sole basis for any decision, and that a human should review AI outputs before they are acted upon, sent, published, or relied upon.
  • You are solely responsible for verifying any AI-generated output before use.

6. No Professional Advice

  • Our platform and its AI agents do not provide legal, financial, tax, accounting, medical, or other professional advice.
  • Any output is provided for general informational purposes only and is not a substitute for advice from a qualified, licensed professional.
  • You should consult an appropriate professional before making decisions based on information generated by the platform. We are not your attorney, accountant, financial advisor, or medical provider, and no professional relationship is created by your use of the platform.

7. Your Responsibility for AI Outputs

  • You are responsible for how AI agents are configured and used in your business, and for all content, messages, calls, and communications generated or sent on your behalf.
  • You are responsible for reviewing and approving outputs, and for ensuring they are accurate and appropriate before they reach your customers or third parties.
  • You are responsible for ensuring your use of the platform complies with all applicable laws and regulations, including those governing communications, marketing, consent, recording, privacy, and consumer protection.

8. SMS Messaging Program

By opting in to receive text messages from Marblism, you agree to receive account-related and customer-care messages (for example: responses to your inquiries, scheduling, and follow-ups) at the phone number you provided. Message frequency may vary. Message and data rates may apply. Reply STOP at any time to unsubscribe; after you send STOP, we will confirm your opt-out and send no further messages.

9. Fees, Subscriptions, and Payments

9.1 Paid Plans. Some features require a paid subscription. Current plans, prices, and included usage allowances are described on our pricing page and are disclosed before purchase.

9.2 Billing and Renewal. Subscriptions are billed in advance on a monthly, quarterly, or annual basis, depending on the plan you select. Your subscription renews automatically at the end of each billing term at the then-current price for your plan unless you cancel before the renewal date. You may cancel at any time from your account settings; cancellation takes effect at the end of your current paid term, and you retain access until then.

9.3 Usage Allowances. Paid plans include a monthly allowance of AI agent work as described on the pricing page. Allowances reset each month, and unused allowance does not roll over. We determine, in our reasonable discretion, which actions consume the allowance and how consumption is measured, and we may refine this measurement methodology over time. When you reach your allowance, AI agent tasks may pause until your allowance resets or you purchase additional usage. We will not charge you for usage beyond your plan without your consent.

9.4 Changes to Plans and Pricing. We may change our plans and pricing from time to time. Changes to your price or plan take effect at your next renewal, and we will notify you by email at least 30 days before any renewal at which a price increase or material plan change applies. If we make a change during a prepaid term that materially reduces the features or usage allowance you purchased, you may cancel within 30 days of our notice and receive a prorated refund of the unused portion of your prepaid term.

9.5 Refunds. New subscriptions include a 7-day money-back guarantee: contact support within 7 days of your first purchase for a full refund. Except as described in Sections 9.4 and 9.5, payments are non-refundable.

10. Termination

We reserve the right to suspend or terminate your access to the platform if you violate these Terms or engage in harmful behavior.

11. Intellectual Property

  • All trademarks and intellectual property related to our platform remain the property of Marblism, Inc.
  • All content generated by your AI Agents are your property.
  • You may not reproduce, distribute, or modify any part of our platform without permission.

12. Disclaimer of Warranties

The platform and all AI-generated outputs are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, secure, or that any output will meet your requirements.

13. Limitation of Liability

To the maximum extent permitted by law, we are not responsible for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, business, or goodwill, arising from or related to your use of (or inability to use) the platform or any AI-generated output. Your use of our services is at your own risk.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the platform shall not exceed the amount you paid us for the services in the twelve (12) months preceding the event giving rise to the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Marblism, Inc and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the platform, your AI-generated content, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

15. Changes to Terms

We may update these Terms from time to time. Continued use of our platform after the effective date signifies acceptance of the revised Terms. If you object to a material change that reduces the value of a prepaid subscription, you may cancel and receive a prorated refund as described in Section 9.4.

16. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Delaware, United States.
